Terms & Conditions for Sellers
By signing up for a seller account on freemark.co.ke you agree to the following terms:
Eligibility:
Artisan working alone: You design and create the products yourself.
Artisan with less than 20 employees: You design and create the products yourself, with a small group of family members and/or employees working with you.
Collaborative group of Artisans: For example, Cooperative, Nonprofit, or Charity. We will consider a variety of groups based on how they are set up to benefit local Artisans.
Category Guidelines
All products listed as Handmade must adhere to the following guidelines:
- Products must be designed and produced by you, or your small group of family members, or employees.
- Products must not be mass produced; this means products cannot be produced in large quantities by an automated mechanical process. Outsourcing of production is prohibited.
- We permit use of hand tools and light machinery; machinery should be used by you in your home studio or workspace.
- We strongly encourage you to do your own printing; however, we also realize some products, like prints of your artwork, or stationery types of products, are sent to an outside printing company due to the cost of the machinery. We will consider this option as long as you are creating the designs and completing the final steps in the production process.
- We will allow you to hand alter pre-made items; for example, we will allow you to apply your own designs to blank t-shirts or mugs.
- We do not allow digital or downloadable products, food or grocery items or electronic accessories on freemark.co.ke.
Intellectual property
You represent that you have all necessary rights to list and sell each product that you offer, including all intellectual property rights as defined in your seller agreement.
We respect the intellectual property rights of the artisans who sell on freemark.co.ke. The goal of freemark.co.ke is to provide customers with an opportunity to buy unique products directly from the artisans who make them.
Copyright, Trademark, and other related policies
We do not allow listings that violate the intellectual property rights of brands or other rights owners. See below for more information:
Copyright - A copyright protects original works of authorship, such as videos, movies, songs, books, musicals, video games, paintings, etc. Generally, copyright law is meant to incentivize the creation of original works of authorship for the benefit of the public. To receive copyright protection, a work of authorship must be created by an author, and must have some amount of creativity. If you are the author of an original work, then you typically own the copyright in that work. Any violation can be reported to admin@freemark.co.ke
Trademark is a word, symbol or design, or a combination of same (such as a brand name or logo) that a company uses to identify its goods or services and to distinguish them from other companies’ goods and services. Put another way, a trademark indicates the source of goods or services. Generally, trademark laws exist to prevent customer confusion about the source of goods or services. Listing requirements
All listings must adhere to our listing guide, including but not limited to our Title, Image, and Product Description Standards.
Protecting Handmade Integrity
Freemark.co.ke reserves the right, in its sole discretion, to remove a product from any category. We will notify the impacted Artisan regarding the removal and the impacted Artisan will have the option to appeal this decision. Notifications will be sent to the Artisan through email and will include details on what handmade policy was violated.
